If you want to use private gardens and yards as smoking areas that are legally part of and for your sole use of your business e.g. beer gardens, it is likely that planning permission will not be required. However if you intend to construct a smoking area/shelter then it is likely permission will be required.
We do not allow free standing shelters, canopies or blinds in Hertsmere however, if you want to erect such fixtures permanently ie fixed to the wall, you will normally require planning permission.

The placement of tables and chairs on the public highway is permitted under the Highway Act 1980. However, you will need consent from the Hertfordshire County Council Highways Department if you wish to do so.
If you want to place portable free standing gas cylinder heaters on the highway you don't normally require planning permission before installing them, but you will need to have consent to place them on the public highway and you may need to carry out a self risk assessment. Consent is not given for heaters alone but form part of a tables and chairs licence.

Ideally any smoking signage should be located inside a shop door or window or within the entrance foyer of a building. If you wish to display signage other than the legally required smoking signs on the exterior of the building eg to advertise where your outdoor smoking facilities are, you are likely to require Advertisement Consent from the Planning Department.
Depending on the location and nature of the work, timber decking may require planning permission. Decking on private property, at the front of properties that are highly visible from public views is not likely to be acceptable however you should consult the both the Planning Department and the Highways Department. Please also be aware that decking is not allowed on the public highway.
If you want to place portable stubbing out boxes on the highway you don’t normally require planning permission before installing them, but you will need to have permission from HCC Highways Department.
If you want to permanently fix a stubbing out box to a wall you may require Planning Consent, in all cases you will need Highways Consent from the HCC Highways Department.
