The Hertsmere Local Plan

Hertsmere Borough Council, as the Local Planning Authority has a statutory duty to guide development within the Borough. The current Local Plan for the Borough is the Hertsmere Local Plan, which was adopted in May 2003 following public consultation and provides a framework for development until 2011.

The Local Plan contains policies relating to a number of important issues including the Green Belt, Housing, Employment and Transport.

The Development Plan, which is used to assess planning applications, is currently made up of the Local Plan along with the Hertfordshire Structure Plan, the Hertfordshire Waste Local Plan and the Hertfordshire Minerals Local Plan.

In 2004, the Government passed a new Planning Act which will see the Structure Plan and Local Plan replaced by Regional Spatial Strategies and Local Development Documents. Further information on these documents will be provided as they are developed by Hertsmere.

IMPORTANT NOTE:

Direction Under Paragraph (13) of Schedule 8 to the Planning and Compulsory Purchase Act 2004 Deletion of Hertsmere Local Plan Policies

Under the terms of the Planning and Compulsory Purchase Act 2004, development plan policies in place at the time of the commencement of the Act were saved for a period of three years, ending on 27 September 2007. In March 2007, the Council submitted to the Secretary of State a list of those policies which it sought to be saved beyond this date.

The majority of the Local Plan policies will remain in place beyond September but the Secretary of State has confirmed that the following policies will cease to have effect from 27 September 2007. These policies are:

The policies marked with an asterisk are those which the Council specifically sought to delete after 27 September 2007. However, the Secretary of State directed that a further seven policies be deleted. Although no justification was given for the deletion of these additional seven policies, the Secretary of State would have had regard to whether polices were out of date, a repetition of national or regional policy or seen as conflicting with the delivery of new housing and economic development.  

Decisions made on or after 27 September 2007, regardless of when the application was submitted, will not be based on these policies.
