Reminder to Hertsmere landlords that they may need an HMO licence

Landlords in Hertsmere are being reminded they may need to apply for a licence for a House in Multiple Occupation (HMO).

Since October 1, private sector landlords who rent out properties or flats of any size occupied by five or more people in more than one household have had to apply for an HMO licence.

So far, the council has received 40 applications.

Previously, only landlords with properties of three or more storeys needed a licence, but under the new rules an estimated 160 to 200 homes could be covered in the borough, meaning the council has received approximately a quarter of the expected number of applications.

There are now new minimum room sizes, so rooms below the minimum size can not now be rented out.

The new legislation, announced in December, also means anyone who has been convicted of offences such as burglary and stalking will be added to a national database of rogue landlords and barred from renting out properties.

Failure to apply for a licence could result in the landlord facing criminal prosecution and a fine of thousands of pounds.

Councillor Jean Heywood, Portfolio Holder for Housing, said: “It is vitally important that landlords apply for a licence if they have an HMO as this will ensure that they are providing homes that meet basic living standards and are safe, secure, well-maintained homes.

“This is the last opportunity to apply for a licence. Failing to do so, will result in the council taking legal action against those who have not complied.”
